The document is a bibliographic research, based on national and foreign precedents, doctrine, legislation, jurisprudence and treaties, referring to corruption in general, and specifically to the crimes of corruption of public officials. On this basis, the factors that negatively influence the ineffectiveness of the State in its investigative and punitive role are determined, through the performance of the representatives of the Public Prosecutor's Office and the Judiciary, which the National Anti-Corruption Policy considers to be key actors of the first order. Contrasting the documentary exploration with the work performance of judges and prosecutors, it is determined that: Although the Peruvian State grants constitutional rank to the fight against corruption, and has established adequate procedural mechanisms for an effective fight against this phenomenon, such as procedural coercive measures (preliminary detention and preventive imprisonment), the results are negative, mainly due to the inaction, complicity, negligence and dysfunctional behaviors perpetrated by magistrates and justice assistants, generally in complicity with the defendants, to the detriment of the nation and the State, which suffer her consequences. The investigation focused its analysis on the Junin Region, where in the period 2021-2022 four cases of corruption involving regional and local authorities and other institutions were registered, in which despite the abundant evidence obtained during the preparatory investigation, including the raids, those implicated were released in pre-trial detention hearings. This situation encourages "political corruption", increases impunity and organized crime.
