This thesis entitled “Lack of regulation of specific issues regarding teleworking in current Peruvian legislation and the consequent violation of the labor rights of teleworkers“, was developed with the main objective of analyzing how the lack of regulation of issues specific regarding telework, in the current Peruvian legislation, violates the labor rights of teleworkers. In this way, the methodology used to carry out this thesis was a methodology of a qualitative nature, that is, this thesis was based on the interpretation and analysis of the normative text, bibliographic sources, and expert opinions on the subject. The study scenario of this research is currently located in Peru that is, in the time after the start of the COVID 19 health crisis, and the approval of the emergency policies and decrees on teleworking, dictated by the government during this quarantine. Due to the qualitative nature of this research, its study unit is made up of research and regulatory texts referring to the legal regulation of teleworking both nationally and internationally, and interviews with experts on the subject, that is, university professors and authors with knowledge about labor law and the regulation of teleworking in current Peruvian legislation. The research techniques used were the analysis of texts and interviews, through the use of texts, text analysis sheets, comparative sheets and interview questions. Finally, this research concluded that the lack of regulation of specific issues regarding teleworking in current Peruvian legislation violates the labor rights of teleworkers indirectly, since there is no regulation of those issues that involve the exercise of teleworking, the labor rights that protect teleworkers from such issues can be completely ignored at the time of teleworking.
