The current situation of the Peruvian legislation regarding the filiation of extramarital children should motivate a reform of the legal devices related to the answer of paternity by virtue of the advance of science and technology that allow today to know with a high degree of certainty the paternity of the people. It is the right of every child to know who their parents are, and that in their birth certificate the name of their true parents is recorded, it is nothing else than the concrete manifestation of the right that every subject has to their own personal identity, a right that it is recognized in article 2, subsection 1 of the Political Constitution of the State, as a fundamental right of the person, a right that, because it is inherent to the human person, has an inalienable, perpetual and opposable character erga omnes. However, in the current regulation it is appreciated that this problem of violation of the constitutional right to identity is being examined in some cases by the Judges through diffuse control; However, this figure is a faculty and not an obligation of the Judge therefore is not vested with the mandatory nature, and may not be applied which generates a serious effect on the right to identity based on biological reality. It is these considerations that motivate the conduct of the present investigation in order to identify grounds that motivate and guide the change of legislation regarding the right of filiation based on biological reality as a manifestation of respect for the right of identity and the superior principle of the child.
