At the end of 2016, the Peruvian administrative legislation had a fundamental reform carried out by the publication of Legislative Decree No. 1272, which involved a total redefinition of institutions and legal figures provided for in Law No. 27444, General Administrative Procedure Law. Among the main modifications of said reform, the legal regime of procedural expiration was incorporated, which again underwent a reform that occurred on the occasion of the publication of Legislative Decree No. 1452. Due to the low number of doctrinal studies and jurisdictional jurisprudence about procedural expiration, our main objective is to document ourselves on it and gather information that would allow us to configure its legal character, discovering its origins, nature, classifications and purpose. This analysis serves to identify the type of expiration that our administrative legislation incorporated in the chapter referring to the regulation of the Administration's sanctioning power. The investigation involves identifying the contrasts resulting from the consecration of administrative expiration in Peru, as well as the dogmatic scope that forms the content and application of this figure. Thus, the main conclusion we reach, after the conclusion of our investigation, is to warn that our administrative legal system configures expiration as a peremptory figure whose effects fall solely on the administrative sanctioning procedure, excluding from its scope applicable to other procedures subject to imposition of lien measures. Likewise, it should be stated that the Peruvian legislation welcomes a characterization of the figure based on its objective, informal, automatic and declarative nature, as well as that its application does not extend to recursive procedures; and as for the terms, the legal system provided the expiration with an acceleration period of 9 months, exceptionally extendable to an additional 3 months.
