The objective of this research was to analyze the legal factors in relation to child marriage that constitute family violence and affect the development and protection of minors' rights in Callao. For this, a type of basic research was proposed, with a non-experimental design, with a qualitative approach. The population was made up of Law 30364, Convention on the Rights of the Child, Code of Children and Adolescents, Civil Code in its article 42, Civil Code in its article 244. Interviews were also carried out with eight experts in the area among Prosecutors, Judges, and lawyers related to the area of family law. The results indicate that daytime child marriage within an environment of family violence leads to an increase in violence and abuse towards minors. It is concluded that it is urgent to propose a multidisciplinary team to review the application files for marriages with minors where the requirements are expanded so that they can be carried out, in addition to this, the Public Ministry intervenes in order to protect the rights of minors.
