Factores legales en la violencia familiar en relación con el matrimonio de menores frente al desarrollo y protección de derechos del menor en el Callao

Abstract

La presente investigación tuvo el objetivo de analizar los factores legales en relación con el matrimonio infantil que configuran violencia familiar y afectan al desarrollo y protección de derechos del menor en el Callao. Para ello se planteó un tipo de investigación básica, con un diseño no experimental, con un enfoque cualitativo. La población estuvo conformada por la Ley 30364, Ley 27337, Convención de los Derechos del Niño, Código del niño y adolescente, Código Civil en su artículo 42, Código Civil en su artículo 244. También se efectuaron entrevistas a ocho expertos en el área entre Fiscales, Jueces, y abogados relacionados con el área de derecho familiar. Los resultados señalan que el matrimonio infantil se da dentro de un entorno de violencia familiar, propicia el incremento de la violencia y el maltrato hacia el menor. Se concluye que urge plantear un equipo multidisciplinario que revise los expedientes de solicitud de los matrimonios con menores donde se amplíen los requisitos para que puedan llevarse a cabo, aunado a ello intervenga el Ministerio Publico a fin de cautelar los derechos de los menores.

The objective of this research was to analyze the legal factors in relation to child marriage that constitute family violence and affect the development and protection of minors' rights in Callao. For this, a type of basic research was proposed, with a non-experimental design, with a qualitative approach. The population was made up of Law 30364, Convention on the Rights of the Child, Code of Children and Adolescents, Civil Code in its article 42, Civil Code in its article 244. Interviews were also carried out with eight experts in the area among Prosecutors, Judges, and lawyers related to the area of family law. The results indicate that daytime child marriage within an environment of family violence leads to an increase in violence and abuse towards minors. It is concluded that it is urgent to propose a multidisciplinary team to review the application files for marriages with minors where the requirements are expanded so that they can be carried out, in addition to this, the Public Ministry intervenes in order to protect the rights of minors.
