Abstract: En la presente tesis se abordó la temática referida al proceso penal peruano, y básicamente se cuestiona la realización del juicio penal con las reglas del proceso penal, en una sola sesión, donde se debe determinar la responsabilidad penal y la sanción penal, debido a ello formulamos el problema de investigación basado en la realidad judicial que ve se presenta pues el juicio en una sola fase no permite una buena determinación de la pena, tampoco permite fortalecer el derecho penal de acto y además impide a la defensa una teoría del caso que pueda ir por la absolución y reducción de la pena; es por ello que se formuló como enunciado del problema, qué ventajas traería la cesura (la división del juicio penal en dos fases: para la culpabilidad y para la determinación de la sanción y reparación civil); en ese sentido se propuso como objetivo general determinar que las ventajas de la cesura son: una mejor determinación de la pena, fortalece un derecho penal de acto, y permite que la teoría del caso sea única y no contradictoria (ir primero por la absolución y luego a la pena); con el análisis del derecho comparado, la doctrina y además de las encuestas a los expertos (operadores del derecho procesal penal) se pudo comprobar la hipótesis planteada.
In the present thesis the subject referred to the Peruvian criminal process was approached, and basically the criminal trial with the rules of the criminal process is questioned, in a single session, where the criminal responsibility and the penal sanction must be determined, due to it we formulate the problem of investigation based on the judicial reality that is presented because the trial in a single phase does not allow a good determination of the penalty, nor does it allow strengthening the criminal law of act and also prevents the defense a theory of the case that can go for absolution and reduction of punishment; that is why it was formulated as a statement of the problem, what advantages the caesura would bring (the division of the criminal trial in two phases: for the culpability and for the determination of the civil sanction and reparation); in that sense, it was proposed as a general objective to determine that the advantages of the caesura are: a better determination of the punishment, strengthens a criminal law of act, and allows the theory of the case to be unique and not contradictory (go first for the acquittal and then to grief); with the analysis of comparative law, the doctrine and in addition to the surveys of the experts (operators of criminal procedure law) the hypothesis could be verified
