Problem: How does article 565 -A of the Code of Civil Procedure in relation to the requirement of admissibility for the exemption of food violate the right of access to justice? Objective: Explain how Article 565 -A of the Code of Civil Procedure in relation to the requirement of admissibility for the exemption of food violates the right of access to justice. Material and Method: A structured questionnaire was applied to a sample of 100 legal professionals by variable, among judges, prosecutors and lawyers. The design was non-experimental transversal. For the statistical analysis, descriptive statistics were used. Results: The requirement of admissibility for the filing of the demand for food exemption violates the constitutional right of access to justice, since this right is subject to a formal requirement, which can not go against a constitutionally protected right. Conclusion: An amendment to Article 565-A of the Code of Civil Procedure is urgently required, in the sense that it is not a requirement for the filing of the demand for food exemption, to be up-to-date in the payment of alimony, since keeping the current text it would mean continuing to collide with article 139 numeral 3 of the Political Constitution of Peru.
