The research that we present arises from the problematic and normative contradiction that exists between two articles, article 593 of the civil procedural code and article 93 of the same regulatory text, which highlights the violation of due legal process and related rights that arise and are analyzed within this research work. This is because article 93 already mentioned makes reference to the necessary passive consortium litigation, an important issue in eviction processes when there is a plurality of subjects linked to said process. It must be determined that article 593 mentioned in the paragraph above generates this violation of rights by not incurring or taking into account article 93 precisely in eviction processes. To address this study, a qualitative approach was adopted, with an explanatory/descriptive level of research. From our study, we have determined that there is a violation of the guarantee of due process and other rights that empower those involved in these eviction processes.
