Resumen: La institución de la Prueba Trasladada, no se encuentra regulada en el NCPP del 2004, pero si
lo está en el art. 20° de la Ley N° 30077, esta ley, autoriza trasladar pruebas documentales,
admitidas o actuadas, solo en los procesos de Crimen Organizado, sin embargo, surge la
interrogante del autor, existe o no la posibilidad de que esta institución también pueda ser
aplicada a la Declaración del Imputado. Ya que, en la referida ley, no está regulado o menos
autoriza su aplicación a pruebas personales. Con la presente investigación el autor pretende
determinar de qué es eficaz aplicar la Prueba Trasladada a la Declaración del imputado en el
proceso de Crimen organizado, debido a que existe referencia positiva en un proceso judicial,
en el Exp. Judicial N°. 001967-2016-70-2701-JR-PE-03. (Caso N° 3606015600-2016-47-0),
tramitado en el 1° JIP de Tambopata de la CSJMDD, en el cual se aplicó al amparo del Principio
de Libertad Probatoria. Asimismo, se pretende establecer de que existen razones de índole
procesal para justificar una propuesta legislativa, para que esta institución procesal pueda ser
regulada taxativamente en el art. 20 de la Ley. N° 30077, Ello hace entrever de que coadyuvará
la labor de investigación del Fiscal en poder identificar a los integrantes y lograr desarticular la
Organización Criminal, al Juez a tener criterios de valoración sobre la Prueba Traslada de
conformidad a lo establecido en el art. 158 del NCPP del 2004. Por tanto, el autor considera
que, si es posible aplicar, siempre en cuando la deposición brindada por el imputado en el
proceso de origen, se haya recibido con todas las garantías de ley, para que en el proceso receptor
al que se desea trasladar tenga la misma eficacia y validez como Prueba Trasladada.
