Abstract: En la presente tesis se profundiza el impacto actual de la democracia deliberativa; además,
se evidencia la ruptura entre el Estado y la población sobre la base del derecho de
participación ciudadana. Para ello, se abordan las implicancias de la democracia en general,
lo que también conlleva un desarrollo de aspectos de importancia de la democracia, así como
las repercusiones que estas ideas han tenido en el actual desarrollo constitucional y la
Constitución Política del Perú de 1993. Finalmente, la investigación busca brindar una nueva
fórmula de desarrollo del procedimiento legislativo, con base en la deliberación, para reducir
la brecha entre el Estado y la población en casos de que los derechos de la sociedad civil se
encuentren vulnerados.
In the present thesis, the current impact of deliberative democracy is deepened; in addition, the rupture between the State and the population on the basis of the right of citizen participation is evidenced. To this end, the implications of democracy in general are addressed, which also entails a development of important aspects of democracy, as well as the repercussions that these ideas have had on the current constitutional development and the Political Constitution of Peru of 1993. Finally, the research seeks to provide a new formula for the development of the legislative procedure, based on deliberation, to reduce the gap between the State and the population in cases where the rights of civil society are violated.
