Resumen: Esta tesis persiguió determinar los fines de la adopción regulados en nuestra
legislación vigente, así como analizar la opinión de expertos en la materia respecto a la
regulación de la licencia por adopción e identificar las repercusiones que trae consigo la
aplicación de la Ley de licencia por adopción en el principio de interés superior del niño
al poder ser otorgada únicamente a la madre y no al padre adoptante. Se buscó como
objetivo general, identificar las razones que justifican una propuesta legislativa para
conceder la licencia por adopción al padre adoptante de la misma manera que la Ley le
concede a la madre desde la perspectiva del Interés Superior del Niño, siendo que dicha
licencia debe ser otorgada de la misma manera al padre adoptante a fin de que pueda
fortalecer el vínculo familiar con el menor en aras de dicho. El enfoque de investigación
utilizado fue el cualitativo por ajustarse de mejor manera a la investigación de ciencias
jurídicas, el tipo de estudio es dogmático propositivo, pues pretende realizar una
propuesta para mitigar la problemática actual y superar las deficiencias encontradas en el
ámbito de la legislación que regula la licencia por adopción. El hallazgo más destacable
de esta investigación es que, existen diversos motivos para el otorgamiento de la licencia
por adopción al padre adoptante, ya que, a través de la Ley N° 27409 se regula la misma
con la finalidad de otorgar al trabajador un descanso, con goce de haber, de 30 días
naturales para que ingrese en un proceso de familiarización con el niño recién adoptado
y se desarrolle un contacto afectivo y parental con la persona que vendría a pertenecer a
un nuevo seno familiar. Siendo así, debe derogarse el artículo 4°- que manifiesta que
cuando los adoptantes sean cónyuges, la licencia se otorgará únicamente a la mujer, en
razón a los principios consagrados respecto a la niñez tanto en el ámbito peruano como
internacional; por todo ello se debe otorgar la licencia por adopción de la misma manera
al padre adoptante a fin de que pueda fortalecer el vínculo familiar con el menor en aras
del principio de interés superior del niño, en cumplimiento de la Convención
Internacional sobre los derechos del niño, nuestra Constitución y la Ley N° 30466 y su
respectivo reglamento.
This thesis sought to determine the purposes of adoption regulated in our current legislation, as well as to analyze the opinion of experts in the field regarding the regulation of the license for adoption and to identify the repercussions that the application of the Law of license for adoption brings on the principle of the best interests of the child, as it can be granted only to the mother and not to the adopting father. The general objective was to identify the reasons that justify a legislative proposal to grant the license for adoption to the adopting father in the same way that the Law grants to the mother from the perspective of the Best Interest of the Child, being that said license must be granted in the same way to the adoptive parent so that he can strengthen the family bond with the minor in pursuit of this principle. The research approach used was qualitative because it was better adjusted to legal science research, the type of study is dogmatically proactive, since it intends to make a proposal to mitigate the current problem and overcome the deficiencies found in the field of legislation that regulates the license for adoption. The most notable finding of this research is that there are various reasons for granting the adoption leave to the adoptive parent, since, through Law No. 27409, it is regulated in order to grant the worker a break, with credit, 30 calendar days to enter a process of familiarization with the newly adopted child and develop an emotional and parental contact with the person who would come to belong to a new family. Thus, article 4 should be repealed - which states that when the adopters are spouses, the license will be granted only to the woman, due to the principles enshrined regarding childhood both in Peru and internationally; For all these reasons, the license for adoption must be granted in the same way to the adopting parent so that he can strengthen the family bond with the minor in pursuit of the principle of the best interests of the child, in compliance with the International Convention on the Rights of the Child. , our Constitution and Law No. 30466 and its respective regulations.
