Abstract: Esta investigación se centra en una de las problemáticas que recientemente ha
significado un gran vacío legal para el estado peruano, pero sobre todo para las
instituciones jurídicas y de salud, ya que en el accionar de estas instituciones se han
podido determinar diferentes vulneraciones a derechos de niñas y adolescentes, por
negárseles el acceso al aborto terapéutico a pesar de ser niñas o adolescentes y que su
vida y salud corre peligro. La investigación busca analizar y entender cuáles son las
razones por las que el aborto debería ser despenalizado en el Perú, buscando definir el
aborto y clasificarlo con la intención de entender de mejor forma por qué es urgente que
se despenalice el aborto en el caso de violación sexual de niñas y adolescentes, ya que
actualmente la legislación peruana solo permite el aborto siempre y cuando la vida de la
mujer corra peligro, dejando esta decisión en manos de un médico, obviando que en
muchas circunstancias son casos traumáticos para estas menores; para ello se realizó
un análisis de dos casos en los que el Perú vulneró los derechos de niñas y adolescentes
que fueron víctimas de violación sexual y producto de ello quedaron embarazadas,
menores a quienes el Estado peruano les negó el aborto por falta de una regulación
específica en los instrumentos legales internos. Finalmente, se busca hacer un cotejo
entre recomendaciones o dictámenes internacionales sobre estos dos casos y la
legislación nacional, para entender como el Estado viene trabajando en reformas legales
y una mayor conciencia sobre la importancia y necesidad de que el Estado peruano
salvaguarde los derechos de las niñas y adolescentes víctimas de violación sexual.
This research focuses on one of the issues that has recently represented a significant legal gap for the Peruvian state, particularly for legal and health institutions. In the actions of these institutions, various violations of the rights of underage women have been identified, as they are denied access to therapeutic abortion despite being minors and facing life-threatening health risks. The research seeks to analyze and understand the reasons why abortion should be decriminalized in Peru, aiming to define and categorize abortion with the intention of better understanding why it is urgent to decriminalize abortion in cases of sexual assault involving minors. Currently, Peruvian legislation only allows abortion when a woman's life is in danger, leaving this decision in the hands of a doctor, overlooking the fact that many circumstances are traumatic for these minors. To achieve this, an analysis of two cases was conducted in which Peru violated the rights of underage victims of sexual assault who became pregnant. These minors were denied abortion by the Peruvian state due to the lack of specific regulations in domestic legal instruments. Finally, a comparison is made between international recommendations or judgments on these two cases and national legislation to understand how the state is working on legal reforms and increasing awareness of the importance and necessity for the Peruvian state to safeguard the rights of underage women who are victims of sexual assault.
