Resumen: La presente investigación busca determinar las consecuencias principales de la
aplicación de la suspensión del curso de la prescripción de la acción penal conforme al artículo 339.1 del Código Procesal Penal, vulnera el derecho al plazo razonable.
Actualmente, bajo las diversas interpretaciones de los operadores del derecho, existe una duda, si se debería aplicar la interrupción o suspensión cuando el fiscal formaliza la investigación, y si se está vulnerando el plazo razonable; pues el tiempo de prescripción se estaría dilatando excesivamente por la prescripción extraordinaria. A su vez, las consecuencias que se derivan de estas, son graves, pues se están vulnerando la seguridad jurídica y el derecho de igualdad. Se ha demostrado que los operadores del derecho no están aplicando lo previsto por la norma adjetiva, existiendo antinomia entre la norma
sustantiva y la norma procesal; todos ello se ha demostrado en la Corte Superior de Justicia de Cusco.
El presente trabajo de investigación tiene enfoque cuantitativo, porque utilizamos la recolección y el análisis de datos para contestar preguntas de investigación y con ello se estaría probando las hipótesis, para lo cual se utilizaron encuestas y análisis de resoluciones judiciales de la Corte Superior de Justicia de Cusco. De igual forma la investigación es de tipo descriptivo, explicativo, porque se está describiendo situaciones específicas, especificando sus características, las cuales han sido sometidas a un análisis exhaustivo.
The present investigation seeks to determine the main consequences of the application of the suspension of the course of the prescription of the criminal action according to article 339.1 of the Code of Criminal Procedure, violates the right to reasonable time. At present, under the various interpretations of the operators of the law, there is a doubt, whether the interruption or suspension should be applied when the prosecutor formalizes the investigation, and if the reasonable time is being violated; Because the time of prescription would be excessive dilating by the extraordinary prescription. In turn, the consequences of these are serious, as they are violating legal security and the right to equality. It has been shown that legal operators are not applying the provisions of the adjective rule, existing antinomy between the substantive rule and the procedural rule; All this has been demonstrated in the Superior Court of Justice of Cusco. The present research work has a quantitative approach, because we used the collection and analysis of data to answer research questions and with that would be testing the hypotheses, for which we used surveys and analysis of judicial decisions of the Superior Court of Justice of Cusco. Similarly, the research is descriptive, explanatory, because it is describing specific situations, specifying their characteristics, which have been subjected to a thorough analysis.
