La eficacia de las medidas de protección de las víctimas de violencia familiar, Ley 30364, en el Décimo Juzgado de Cusco -2022

Abstract

La presente investigación tiene como objetivo, demostrar que las Medidas de Protección otorgadas por el Décimo Juzgado de Familia del Cusco, no son eficaces, en razón de que no se realiza una correcta ejecución por parte de los Operadores Jurídicos, en este caso hablamos del Poder Judicial y la Policial Nacional de Perú, para dicho fin, se utilizó una metodología cualitativa y diseño descriptivo; asimismo, mediante la técnica de encuesta practicada a las víctimas y agresores; entrevistas realizadas a fiscales, jueces, abogados especializados en violencia familiar y la Policía Nacional del Perú, donde se pudo recabar la información sobre la ejecución de las medidas de protección, de esta manera se pudo obtener diferentes opiniones, que se llegó a determinar que las Medidas de Protección no cumplen su objetivo que es el de prevenir y erradicar la violencia contra las mujeres o los Integrantes del Grupo Familiar.

The objective of this investigation is to demonstrate that the Protection Measures granted by the Tenth Family Court of Cusco are not effective, because correct execution is not carried out by the Legal Operators, in this case we are talking about the Power Judicial and the National Police of Peru, for this purpose, a qualitative methodology and descriptive design were used; Likewise, through the survey technique carried out on victims and aggressors; interviews were carried out with prosecutors, judges, lawyers specialized in family violence and the National Police of Peru, where information could be collected on the execution of protection measures, in this way different opinions could be obtained, which determined that the Protective Measures do not fulfill their objective, which is to prevent and eradicate violence against women or members of the family group.
