The research examines the legal implications stemming from Peruvian constitutional jurisprudence regarding gender change on Birth Certificates and National Identity Documents (DNI), highlighting the legal evolution from the 1933 Constitution to the present, and focusing on the role of the National Registry of Identification and Civil Status (RENIEC). It analyzes name and gender changes, particularly in the judicial realm, and the establishment of new jurisprudence by the Constitutional Court, allowing civilian judges to manage these requests. The issue revolves around identifying the legal implications, procedures, and consequences across various branches of law. Objectives encompass identifying legal implications, understanding procedures, and legal consequences. The research method is exploratory and qualitative, utilizing expert interviews and documentary analysis, with an estimated duration of twelve months. The results reveal a stringent judicial process for modifying name and gender in Peru, ensuring records reflect gender identity and implicitly allowing same-sex marriage. This carries significant repercussions, such as the possibility of adoption, underscoring the importance of comprehensive analysis and a robust legal framework to safeguard the rights of all involved parties.
