The general objective of this investigation was to analyze the non-compliance with the labor rights of the porter workers who carry out their work on the Inca Trail network by the tourism agencies and inspections of the national superintendency of labor inspection, for which The research was carried out using a non-experimental design, of a socio-legal type with a qualitative approach. To collect the information in question, a survey was carried out on 150 porters who carry out their work on the Inca Trail network, who were asked and applied the data instruments, which collect information on compliance with the new law of porters 31614 by the tourism agencies and the inspections carried out by the national superintendence of labor inspection respectively. These research results show dissatisfaction on the part of the porter workers of the Inca Trail network towards the new porter law 31614 because the tourism agencies do not comply with the requirements established within said law and worse still, there is no an adequate inspection by the national superintendency of labor inspection that allows porter workers to carry out their work in an ideal manner. Problem: This investigation analyzed the non-compliance in the application of the new porter worker law 31614 by tourism agencies and the non-compliance with labor rights by SUNAFIL towards the porter workers of the Inca Trail network, problem which can still be seen to this day. General objective of this research was to identify the non-compliance with the labor rights established in the new carrier law 31614 by the tourism agencies and the SUNAFIL entity in the period 2022 to 2023. Methods: The research adopted a qualitative approach, Sociolegal type given that a social problem will be addressed from a legal perspective. Information was collected from tourism agencies, SUNAFIL and the porter workers of the Inca Trail network. Hypothesis: The hypothesis of the investigation was that tourism agencies, such as the SUNAFIL entity, fail to comply with the provisions of the new carrier law 31614, generating a violation towards these workers. The conclusions of the research were: porter workers have a fundamental role in the Inca trail network, because they are the ones who have direct contact with tourists who come from far away to see one of the 7 wonders of the world. That is why we cannot ignore the violations carried out by tourism agencies towards porter workers, even more so taking into account that they are supported by the New Carrier Worker Law 31614. On the other hand, we have an entity like SUNAFIL that has Its function is to carry out inspections to protect the rights of these workers; however, according to the interviews carried out with the porters, it is a function that this entity does not execute.
