On November 23, 2015, the Peruvian law 30364, was published in the Peruvian daily newspaper EL PERUANO, a law to prevent, punish, and eradicate violence against women and members of the family group, the same which repealed law 26260, law to of protection against family violence. In this context, the present work is oriented, taking into consideration that this new law has been positively qualified by the state to fight against violence women; nevertheless, we affirm that trough law 30364 ineffective mechanisms are incorporated to protect women against violence. For this purpose, 84 cases have been reviewed in the Cusco family courts, that means those processed during the first month of law 30364, for the referral of cases reported to the criminal prosecution have results Ineffective, as well as the procedures for the issuance of measures to protect women victims of violence. Due the analysis that we make of the first month ´s validity of Law 30364, the deadline for issuing protection measures in 72 hours is not fulfilled, and, on the other hand, concrete actions have not been established to allow compliance with these protection measures initially issued by the family Judge. As itself the cases that are derived to the criminal prosecutions, in some situations they are sent without the protocols of fiscal or psychological expertise and if these exist it is not detailed the information on how many days of incapacity is determined for example for the case in psychological damage. Thus the work is focused, demonstrating from the cases reviewed that the current law still does not fully guarantee the rights of women victims of violence since it has been incorporated with ineffective mechanisms for their itselves security.
