Abstract: La propiedad es un derecho constitucionalmente reconocido, doctrinariamente es
reconocido como un derecho absoluto, sin embargo, existe la posibilidad de establecer
restricciones legales y convencionales a dicho derecho. El objetivo principal de esta
investigación se ha centrado en determinar los efectos que producen las restricciones
convencionales al derecho a la propiedad en la autonomía de la voluntad. La hipótesis fue
“los efectos de las restricciones convencionales al derecho a la propiedad en la autonomía
privada de la voluntad tienen una contraposición entre el principio de libertad contractual
y el ejercicio de las facultades del derecho de propiedad”. Se utilizó un enfoque de
investigación cualitativo del tipo dogmático-exploratorio. La población está conformada
por los contratos de mutuo hipotecario celebrados con entidades financieras en el Perú.
La muestra es no probabilística por conveniencia conformada por los contratos de mutuo
con garantía hipotecaria del 2020 al 2021. En los resultados de la investigación se llegó a
establecer la colisión entre el ejercicio pleno del derecho de propiedad y la autonomía de
la voluntad del propietario al celebrar negocios jurídicos con entidades financieras
restringiendo convencionalmente el derecho a la propiedad, desnaturalizando, de esta
manera, el contenido esencial de la propiedad, como derecho absoluto, y de la libertad
contractual en la celebración de actos que no vayan en contra del orden público ni las
buenas costumbres.

The main objective of this research has focused on determining the effects produced by conventional restrictions on the right to property on the autonomy of the will. The hypothesis was "the effects of the conventional restrictions to the right to property in the private autonomy of the will have a contrast between the principle of contractual freedom and the exercise of the faculties of the right of property". A qualitative research approach of the dogmatic-exploratory type was used. The population is made up of mutual mortgage contracts entered into with financial entities in Peru. The sample is non- probabilistic for convenience, made up of the mutual contracts with mortgage guarantee from 2020 to 2021. In the results of the investigation, the collision between the full exercise of the property right and the autonomy of the owner's will was established. enter into legal transactions with financial entities conventionally restricting the right to property, thus distorting the essential content of property, as an absolute right, and contractual freedom in the performance of acts that do not go against public order or good manners.
