The present research study was born as a result of the non-application of the principle of reasonableness in the administrative procedure sanctioning traffic infraction tickets code M1. In this sense, the purpose of the present investigation has been to describe the non-application of the principle of reasonableness in the administrative sanctioning procedure of the traffic infraction ballots code M1. Well, we know that any administrative sanctioning procedure is governed by the sanctioning principles stipulated in the Single Ordered Text of Law 27444, being of mandatory application for due process. For this reason, the present study is approached with a qualitative approach, assuming the non-experimental design. Therefore, as a result after describing how the principle of reasonableness is implied in the ballots for M1 infraction, it originates from the presence of municipal administrative personnel not trained in handling administrative sanctioning procedures, being a special procedure and the absence of levels according to the degree of the infraction with code M1 which does not excuse a proper interpretation of the principles of reasonableness, legality and typicity; generating a literal, widespread, abusive and disproportionate application of the payment of a total fine; in addition to the sanction of disqualification of the driver's license and the prohibition to obtain a new license; without taking into account the circumstances of the event that could mitigate the sanction.
