Abstract: El propósito de la presente investigación ha sido analizar si los jueces en el Perú están o
no aplicando el control de convencionalidad en relación con la defensa de los Derechos
Humanos. Los derechos fundamentales son importantes, dado que son garantías
esenciales e inherentes a la persona humana, sin embargo, al no aplicarse los criterios
adecuados en relación con el control de convencionalidad, como consecuencia se tiene la
afectación de estos derechos, ante tal situación muchos tienen que demandar ante la
Comisión Interamericana y, posteriormente ante la Corte Interamericana la tutela efectiva
de estos derechos, reclamando se haga un verdadero control de convencionalidad. Para
este efecto en la tesis se ha desarrollado una investigación de carácter dogmático dado
que se ha orientado al análisis de algunas jurisprudencias emanadas por la Corte
Interamericana de Derechos Humanos. Como resultado se ha podido evidenciar en
algunos casos, la falta de control de convencionalidad lo cual ha vulnerado derechos
fundamentales como es el derecho fundamental al derecho al trabajo, derechos a la
igualdad y no discriminación, derecho a la seguridad social y la vida digna, derecho a la
propiedad, si como a las garantías judiciales, plazo razonable, principio de legalidad,
derecho a la protección judicial, obligaciones de respetar y garantizar derechos entre
otros.
The purpose of this investigation has been to analyze whether or not judges in Peru are applying conventionality control in relation to the defense of Human Rights. Fundamental rights are important, given that they are essential and inherent guarantees of the human person, however, by not applying the appropriate criteria in relation to the control of conventionality, as a consequence these rights are affected, in such a situation many have to sue before the Inter-American Commission and subsequently before the Inter- American Court for the effective protection of these rights, demanding that a true control of conventionality be carried out. For this purpose, a dogmatic investigation has been developed in the thesis since it has been oriented towards the analysis of some jurisprudence issued by the Inter-American Court of Human Rights. As a result, in some cases it has been possible to demonstrate the lack of control of conventionality, which has violated fundamental rights such as the fundamental right to the right to work, rights to equality and non-discrimination, right to social security and a decent life, right to property, as well as to judicial guarantees, reasonable time, principle of legality, right to judicial protection, obligations to respect and guarantee rights among others.
