Unificación de criterios en la aplicación del precedente vinculante Expediente N° 5057-2013-PA/TC en la Corte Superior de Justicia del Cusco, periodo 2018-2019

Abstract

La presente tesis realizó la descripción de Unificación de criterios en la aplicación del precedente vinculante, expedienté N 5057-2013-PA/TC en la corte superior de justicia del Cusco, periodo 2018-2019, para describir esta regulación se planteó la siguiente interrogante, ¿Cómo es la unificación de criterios en la aplicación del precedente vinculante, expedienté N 5057-2013-PA/TC en la corte superior de justicia del Cusco, periodo 2018-2019? por ende, como objetivo general se planteó Describir la unificación de criterios en la aplicación del precedente vinculante, expedienté N 5057-2013-PA/TC en la corte superior de justicia del Cusco, periodo 2018-2019. En la metodología, se utilizó el enfoque que viene a ser cualitativo, el tipo de investigación es descriptivo, donde se describe la categoría y sus subcategorías; la población de estudio está conformada por 622 expedientes judiciales en materia laboral con la pretensión de reposición de la Corte Superior de Justicia del Cusco periodo 2018-2019; en la técnica revisión documentaria y la entrevista y en los instrumentos la guía de revisión documentaria y entrevista. Se aplicó un diseño no experimental, en la cual participaron 05 entrevistados considerados relevantes para la presente investigación, para ello se utilizó como instrumento una entrevista. En los resultados se muestra que la “La unificación de criterios en la aplicación del precedente vinculante, expedienté N 5057-2013-PA/TC en la Corte Superior De Justicia Del Cusco, Periodo 2018-2019, se evidencia que no se ha logrado unificar criterios al momento de la emisión de resoluciones judiciales, debido a que no se hace uso de una correcta fundamentación al no valorarse cada caso de manera objetiva, generando variedad de interpretaciones al precedente Huatuco, afectando el carácter de predictibilidad a las resoluciones emitidas por los magistrados, por lo cual se plantea la presente investigación.

In the methodology, the approach that is qualitative was used, the type of research is descriptive, where the category and its subcategories are described; The study population is made up of 622 judicial files on labor matters with the claim of reinstatement of the Superior Court of Justice of Cusco period 2018-2019; in the documentary review technique and the interview and in the instruments the documentary review and interview guide. A non-experimental design was applied, in which 05 interviewees considered relevant for this research participated, for which an interview was used as an instrument. The results show that the “The unification of criteria in the application of the binding precedent, file N 5057-2013-PA / TC in the Superior Court of Justice of Cusco, Period 2018- 2019, it is evident that it has not been possible to unify criteria at the time of issuance of judicial decisions, due to the fact that a correct foundation is not used as each case is not evaluated objectively, generating a variety of interpretations to the previous Huatuco, affecting the predictability nature of the decisions issued by the magistrates , for which the present investigation is proposed.
