The purpose of the research focused on determining the harmful consequences to the principle of the best interest of the child as a result of the restriction of freedom in cases of omission of family support. The study analyzed how the imposition of custodial sentences for omission of family support compromises or affects the fulfillment of the best interest principle of the child. It described the application and determination of the best interest principle in such processes, considering the fundamental indicator of the limitation in the psychophysical capacity of the alimentary debtor due to custodial sentences. The aim was to determine if this action is effective in fulfilling the support obligation. The research adopted a qualitative approach, allowing data collection through the interview guide instrument. The interviews were conducted with ten legal specialists in family and criminal law. This approach provided insights into the experiences and perspectives of the interviewees. The results achieved the study objectives, demonstrating that there is indeed a violation of the best interest principle due to the imposition of custodial sentences in cases of omission of family support. The interviewees acknowledged that this measure is detrimental to minor beneficiaries and restricts the fulfillment of the support obligation, impacting parent-child relationships and limiting family bonds. Finally, there was agreement that in the process of omission of family support, the state, through qualified personnel, should ensure the protection of the interests of the child. In conclusion, the study formulated conclusions based on the stated objectives, integrating theoretical concepts and considering the perspectives of various authors on the violation of the child's best interest principle. Recommendations were formulated, including promoting the conversion of sentences in cases of omission of family support by the process director. Additionally, the proposal suggested integrating a multidisciplinary team for the protection of children's rights in processes involving them, in line with the Inter-American Court of Human Rights and the code for children and adolescents.
