Efectividad de las medidas de protección de la ley 30364 en casos de violencia familiar en el Segundo Juzgado Civil Canchis-Sicuani Corte Superior de Justicia de Cusco año 2022.

Abstract

La presente tesis “Efectividad De Las Medidas De Protección De La Ley 30364 En Casos De Violencia Familiar En El Segundo Juzgado Civil Canchis – Sicuani De La Corte Superior De Justicia De Cusco, Año 2022” tuvo por finalidad determinar si existe la debida efectividad de las medidas de protección en victimas de agresión física y psicológica. Se investigó también los elementos a tomar en cuenta para valorar la adecuada emisión de medidas de protección para víctimas de violencia familiar y grupo familiar que están establecidos en la ley 30364 ley para prevenir y sancionar y erradicar la violencia contra las mujeres y los integrantes del grupo familiar. La presente investigación se basó en la información de algunos expedientes del segundo juzgado civil de Canchis del año 2022, donde se analizó minuciosamente la decisión resolutoria del juez, así como encuestas a personal jurisdiccional de la institución, y también se hizo uso de doctrina y jurisprudencia para sustentar el marco teórico relacionado a nuestro trabajo de investigación. En este sentido, esta ley no solo establece obligaciones para investigar y juzgar y sancionarlos casos de violencia con debida diligencia reforzada desde el ámbito penal, si no también que dispone el otorgamiento de medidas de protección de acuerdo con el riesgo de las víctimas, con dicho horizonte la presente tesis se divide en tres capítulos

The first of them states in a simple way the startingpoints (identify the problem) and analysis and conclusion that we propose, it is where we see what we will develop. In the second chapter of analysis is the thematic development that shows the basic theoreticalconcepts around the subject in question, with emphasis on the problematic points, it also develops the International, National and Local standards for the protection of the rights of victims.
