Legal certainty is a constitutional guarantee, which is not explicitly outlined in our legal system. However, it covers the whole extension of the same, which is very important for all branches of law. That is why, going into civil law, specifically in notarial and registry law, we analyze the alternatives to the notarial function as guarantors of legal certainty against public records of the registry area No. X - Cusco. In which the notary is saturated and does not effectively fulfill the service of guaranteeing security to the population in the different acts and documents that they intend to present before public registries, among other entities. Therefore, our research is based on developing alternatives to the notarial function that are beneficial to the population, which not only guarantee their rights but also favor the reduction of costs, time, and money. The research had a qualitative approach in which two techniques and instruments for data collection were used, where the interview with legal operators was propitiated to deepen data on their attributions to the position they perform, and the documentary analysis in data collection, in doctrine and comparative legislation; complemented with an interview form and an observation form for the better reception of data. Satisfactory results were obtained, in terms of the response to the general objective as well as the specific objectives, being able to affirm that the alternatives to the notarial function, such as digital signature and digital certificate, as well as the notarial functions empowered by law performed by the justices of the peace, notaries, and consuls are valid; therefore benefiting the population being an option to perform documentary procedures by these means; which leads us to conclude that if they prove to be guarantors of legal certainty against public records, as well as against other public institutions.
