Seguridad jurídica y nuevas alternativas a la función notarial frente a Registros Públicos – Zona Registral N.º X – Sede Cusco

Abstract

La seguridad jurídica es una garantía de grado constitucional, la cual no está plasmada en nuestro ordenamiento jurídico explícitamente. Pero abarca toda la extensión del mismo, la cual resulta muy importante para todas las ramas del derecho. Es por ello que, adentrándonos en el derecho civil, específicamente en el derecho notarial y registral, analizamos las alternativas a la función notarial como garantes de seguridad jurídica frente a registros públicos de la zona registral N.º X – sede Cusco. En la cual, el actuar notarial se encuentra saturado y no cumple de manera eficaz el servicio de garantizar seguridad a la población en los diferentes actos y documentos que pretenden presentar ante registros públicos, entre otras entidades. Por ello, nuestra investigación se basa en desarrollar alternativas a la función notarial que resultan beneficiosas para la población, la cual no solo garantizan sus derechos, sino que favorecen la reducción de costos, tiempo y dinero. La investigación tuvo un enfoque cualitativo, en el cual se utilizó dos técnicas e instrumentos de recolección de datos, donde se propició la entrevista a operadores del derecho para profundizar datos sobre sus atribuciones al cargo que desempeñan, y el análisis documental en la recolección de datos, en doctrina y legislación comparada; complementándose con una ficha de entrevista y una de observación para la mejor recepción de datos. De los cuales se obtuvo resultados satisfactorios, en cuanto a la respuesta del objetivo general como los objetivos específicos, pudiendo afirmar que las alternativas a la función notarial, tales como firma digital y certificado digital, como también las funciones notariales facultadas por ley que realizan los jueces de paz, fedatarios y cónsules son válidas; por ende benefician a la población siendo una opción para realizar trámites documentarios por estas vías; lo que nos lleva a concluir que si resultan ser garantes de seguridad jurídica frente a registros públicos, como también frente a otras instituciones públicas.

Legal certainty is a constitutional guarantee, which is not explicitly outlined in our legal system. However, it covers the whole extension of the same, which is very important for all branches of law. That is why, going into civil law, specifically in notarial and registry law, we analyze the alternatives to the notarial function as guarantors of legal certainty against public records of the registry area No. X - Cusco. In which the notary is saturated and does not effectively fulfill the service of guaranteeing security to the population in the different acts and documents that they intend to present before public registries, among other entities. Therefore, our research is based on developing alternatives to the notarial function that are beneficial to the population, which not only guarantee their rights but also favor the reduction of costs, time, and money. The research had a qualitative approach in which two techniques and instruments for data collection were used, where the interview with legal operators was propitiated to deepen data on their attributions to the position they perform, and the documentary analysis in data collection, in doctrine and comparative legislation; complemented with an interview form and an observation form for the better reception of data. Satisfactory results were obtained, in terms of the response to the general objective as well as the specific objectives, being able to affirm that the alternatives to the notarial function, such as digital signature and digital certificate, as well as the notarial functions empowered by law performed by the justices of the peace, notaries, and consuls are valid; therefore benefiting the population being an option to perform documentary procedures by these means; which leads us to conclude that if they prove to be guarantors of legal certainty against public records, as well as against other public institutions.
