The present investigation arises from the issuance of the Resolution of the Board of Directors No. 109-2019-CD / OSIPTEL published on August 22nd, 2019; which extends the validity of extraordinary measures No. 51-2018-CD / OSIPTEL related to the procedure of attention to public telecommunications services users claims. Due to the approval of mentioned standard, an inconsistency arises with one of the fundamental principles of the Supervisory Agency for Private Investment in Telecommunications, we refer to the action taken based on the cost-benefit analysis, which says that the periodic and scheduled actions taken by OSIPTEL, will be evaluated before its realization and must be adequately supported by studies and technical evaluations that prove its rationality and effectiveness. This evaluation will consider both short and long-term projections, as well as direct and indirect costs and benefits, monetary or non-monetary. Thus, I have been able to identify that, by the approval of the measures mentioned before, they would be limiting the telecommunications services users rights to be able to follow an administrative claim procedure in a timely and efficient way, because of the different subjects that regulates the Supervisory Agency for Private Investment in Telecommunications; therefore, as a way to resolve the situation in which it places the user extraordinary measures, we would take the Regulatory Impact Analysis as a means, since it is an instrument that seeks to guarantee the public policy actions or decisions that the authorities assume are based on the principle of cost-benefit analysis. This is why, in the research presentation we will address the basic concepts as well as the reasons why the extraordinary measures were approved, in the same way, we will verify that the decree doest not protect the user.
