The current study investigates deficiencies in the due administrative sanctioning procedure, identifying problems in supervision and notification. The entity responsible for the audits must exhaust the administrative route before proceeding legally, allowing the institution's Office of the Prosecutor to take legal action in case of persistent infringing behavior. Each management, responsible for supervising different aspects, issues a report to initiate legal action against those who refuse to close their establishments or stop works, among other infractions. If the complaint reaches the fiscal office and is archived, it indicates that the institution has exhausted all administrative avenues. The inefficiency in this supervision leads to an excessive workload on the Office of the Prosecutor, forced to legally act against the reports of presumed disobedients. This situation worsens when the administrators do not comply with orders from the San Sebastián District Municipality, including closures and precautionary measures. This analysis aims to highlight the need to improve supervision and notification processes to reduce the burden on the Prosecutor's Office and ensure compliance with administrative provisions.
