Abstract

Aportando una alternativa al conocimiento jurídico, se pone a consideración la tesis titulada: “EL PAGO RACIONAL DE LA REPARACIÓN CIVIL EN EL DELITO DE CONDUCCIÓN DE VEHÍCULO EN ESTADO DE EBRIEDAD EN LA FISCALÍA PROVINCIAL PENAL DE WANCHAQ EN EL SEGUNDO SEMESTRE AÑO FISCAL 2016”. El objeto principal de este proyecto de investigación es determinar si es racional el pago de la reparación civil por acogerse a principio de oportunidad en los delitos de conducción de vehículo en estado de ebriedad. Asimismo, como objetivos secundarios se tiene analizar si el aspecto económico es limitante para que el agente infractor de la naturaleza penal se someta al principio de oportunidad en el delito de conducción de vehículo en estado ebriedad, así como analizar la naturaleza jurídica del principio de oportunidad en el delito de conducción de vehículo en estado de ebriedad, finalmente analizar si el aspecto económico es el único medio para que el agente infractor se someta al principio de oportunidad en el delito de conducción de vehículo en estado de ebriedad. En ese sentido, la investigación está estructurada en cuatro capítulos: el capítulo primero es referente al problema de investigación, el mismo que aborda el planteamiento y formulación del problema, objetivos, justificación y viabilidad de la investigación. El capítulo segundo trata sobre el marco teórico y/o bases teóricas. El capítulo tercero es referente a la metodología, consisten en el diseño, población y muestra, técnicas e instrumentos de recolección de datos. El capítulo cuarto trata sobre los resultados de la investigación, y por último el capítulo quinto donde se pone en conocimiento de todos, las conclusiones, recomendaciones y anexos.

The main objective of this research project is to determine whether it is rational to pay civil damages for being eligible for the principle of opportunity in driving while intoxicated. Likewise, secondary objectives have to be analyzed if the economic aspect is limiting for the offender of the criminal nature to be subject to the principle of opportunity in the crime of driving while intoxicated, as well as to analyze the legal nature of the principle of opportunity In the crime of driving drunk, finally to analyze whether the economic aspect is the only means for the offending agent to submit to the principle of opportunity in the crime of driving while intoxicated. In this sense, the research is structured in four chapters: the first chapter refers to the research problem, which addresses the approach and formulation of the problem, objectives, justification and feasibility of research. The second chapter deals with the theoretical framework and / or theoretical bases. The third chapter refers to the methodology, consisting of the design, population and sample, techniques and instruments of data collection. The fourth chapter deals with the results of the thesis project, and finally the fifth chapter where I bring to the attention of all, the conclusions, recommendations and annexes.
