Evidentiary practice to accredit abuse of vulnerability in cases of trafficking in persons, in the Fiscal District of Madre de Dios, 2018; in an investigation that tries to demonstrate how the commissive means is accredited abuse of situation of vulnerability in the cases of human trafficking in our Fiscal district, during the 2018 period. For this, the condemnatory and absolving sentences have been taken as a main reference since in them the whole of the process is captured, the claims of the parties as well as the assessment of the evidence presented by each one of them; and having as its main character - for the purposes of the investigation - the prosecutor, on the other hand, there have been inconsistent arguments and without evidentiary support that claim in a certain way to accredit the abuse of the situation of vulnerability. The position adopted by the present investigation maintains that such fiscal arguments are not sufficient, therefore, the lightness of its evidentiary practice affects the fundamental rights of the person, as well as the process. To demonstrate this, the research will be developed in FOUR chapters, each one with essential content of what corresponds, being the last chapter the one that will discuss the most outstanding aspects of the investigation.
