The present research entitled "The violation of the principle of presumption of veracity and the lack of implementation of the electronic signature for the procedures of withdrawal of reservation of name", part of correlating the principle of presumption of veracity and the lack of implementation of the electronic signature for the procedures of withdrawal of reservation of name; The objective of the research was to explain how the principle of presumption of veracity is violated by the lack of implementation of the electronic signature for the procedures of withdrawal of reservation of name. The research is qualitative approach, basic type, explanatory level and non-experimental design; techniques and instruments were used, such as interviewing 06 officials of the National Superintendence of Public Registries (Sunarp); Likewise, the documentary analysis was carried out. This research had as a hypothesis that, the violation of the principle of presumption of veracity due to the lack of implementation of the electronic signature for the procedures of withdrawal of reservation of name, is given by the requirement of Public Registries of the signature certified by notary public or notary of the institution as a requirement in the process of withdrawal of reservation of name; the electronic signature or mechanism that serves as an expression of the user's will has not been implemented; which is related to the conclusion of the investigation: The violation of the principle of presumption of veracity due to the lack of implementation of the electronic signature for the procedures of withdrawal of reservation of name occurs with the requirement of Public Registries of the signature certified by Notary Public or notary of the institution, in application of art. 13 of the General Regulation of Public Registries, without considering Resolution 001-2021-SUNARP / SA, which approves the Directive that regulates the online procedure of the reservation of registration preference of name, denomination or company name, it provides that the reservation of name is presented and processed entirely online, including the withdrawal procedure.
