The Peruvian Code of Civil Procedure contains several legal deficiencies, one of them being Article 594, which regulates the eviction with a clause of acceptance, as amended by Law 30201 (Law that amends Article 594 of the Code of Civil Procedure). The legal deficiency of article 594 is related to whether or not at the time of filing the lawsuit before the court it is necessary to attach the prior extrajudicial conciliation act as one of the procedural requirements, since the law is not clear on this matter; It must be taken into account that article 594 of the Code of Civil Procedure has been modified by Law No. 30201 with the purpose that the citizen who goes to the jurisdictional body obtains his claim in a more expeditious manner, however, the eviction with acceptance clause is regulated within the title that regulates the summary proceeding. The purpose of this research work is to determine whether it is necessary to regulate the enforceability of the prior extrajudicial conciliation in eviction proceedings with an "allanamiento" clause, due to the problem described in the preceding paragraphs, as well as to determine the legal-social grounds that would justify such regulation, and to determine the effects that would result from the regulation of whether or not the extrajudicial conciliation act in eviction proceedings with an "allanamiento" clause is a requirement of admissibility of the lawsuit.
