The general objective of this research was to establish how the amendment of the law on foster families could promote its application in favour of the principle of the superior of the child in Peru. To this end, literary research was carried out on concepts such as the superior principle of the child and foster families. The study of comparative legislation was also a reason to improve their legislative and practical development. Its realization sought to expand a doctrinal and argumentative research, applying a documentary analysis with a hermeneutic design. The problem of child neglect and abuse is one of the main social problems in Peru, and has been present in Peruvian society for many years. It is a social problem understood as the lack of care and attention towards children by their parents or guardians. This can be manifested in various ways, such as physical neglect, emotional neglect, physical abuse or psychological abuse. Welcoming families in Peru are those that take in children who have been separated from their biological parents for various reasons. The majority of these children come from poverty and the vulnerable situation they live in prevents them from having a decent life. Welcoming families in Peru are in dire need.
