The general objective of the investigation was "To determine if there is a violation of the labor rights in terms of Occupational Health and Safety of the workers of the Wanchaq district responsible for solid waste management"; used a non-experimental design, qualitative approach, basic type and descriptive scope, for data collection I used documentary analysis, interview and observation as techniques, and an interview guide as instruments, it took as unit of analysis 28 workers responsible for solid waste management. Results: in reference to Occupational Safety, it is concluded that the occupational safety of workers responsible for solid waste management in the municipality of Wanchaq is being violated, observing the lack of personal protection equipment, of low quality and even inadequate for collection. and transport of solid waste, the lack of biosafety elements for covid-19, being scarce and tending to be acquired by the workers themselves, missing tools such as bags and brushes for cleaning and collecting waste, not counted with an adequate camp, harming the safety of each worker, where the bathrooms are in terrible conditions, not having lockers for changing clothes, on the other hand, training is occasional, without professionals who know the processes and dangers of working with Solid waste. In reference to Occupational Health, it is concluded that the occupational safety of the workers responsible for the management of solid waste in the municipality of Wanchaq is being violated, it was possible to show that the vaccination schedule for tetanus and tetanus vaccines is not complied with. Hepatitis B, there are no regular average check-ups and on the other hand there is the presence of hazardous waste in the collection, transportation and final disposal processes that aggravates the health violation.
