Abstract: La presente investigación, tuvo como objetivo general determinar el objeto del
contrato, a efectos de regular la maternidad subrogada como contrato en el Libro VII,
Fuente de las Obligaciones del Código Civil Peruano. Por ello, el método aplicado al
estudio fue de diseño cualitativo no experimental, bajo las corrientes dogmático –
interpretativo – propositivo, el diseño fue jurídico descriptivo y propositivo. Asimismo,
el escenario de estudio fueron los casos de vientre de alquiler a nivel nacional
efectuados durante el periodo 2015 -2020. La técnica aplicada fue el análisis
jurisprudencial y el instrumento respectivo, ficha de análisis jurisprudencial. A partir de
ello, se concluye que: aunque la legislación peruana ha tratado de conferirle
revestimiento a la maternidad subrogada, este no llega a cumplir con los requisitos que
establece el artículo 140 del Código Civil para ser considerado acto jurídico válido.
Aunque las partes pueden manifestar de manera libre y consciente su voluntad de querer
obligarse entre sí; el objeto y acuerdo no se ajustan al Derecho, además con su ejecución
y celebración se contravienen normas y principios que son de interés para el orden
público.
The general objective of this research was to determine the object of the contract, in order to regulate surrogacy as a contract in Book VII, Source of the Obligations of the Peruvian Civil Code. Therefore, the method applied to the study was of non-experimental qualitative design, under the dogmatic – interpretative – propositional currents, the design was legal descriptive and propositional. Likewise, the study scenario was the cases of surrogacy at the national level carried out during the period 2015 -2020. The technique applied was the jurisprudential analysis and the respective instrument, jurisprudential analysis sheet. From this, it is concluded that: It follows that: although Peruvian legislation has tried to confer cover to surrogacy, it does not meet the requirements established in Article 140 of the Civil Code to be considered a valid legal act. Although the parties can freely and consciously express their willingness to link with each other; the object and the agreement do not conform to the Law, in addition to its execution and conclusion contravene rules and principles that are of interest to public order.
