El régimen de visitas y el derecho de alimentos como condición al acceso a la justicia en los juzgados de Tambopata

Abstract

El presente trabajo de investigación “EL REGIMEN DE VISITAS Y EL DERECHO DE ALIEMNTOS COMO CONDICION AL ACCESO A LA JUSTICIA EN LOS JUZGADOS DE TAMBOPATA”, surge la problemática jurídico social, porque afecta a todas las familias del país inmersos en los procesos de régimen de visitas, de aquellos padres que reclaman el derecho por sus hijos hasta los mismos menores de edad que cuentan con el derecho constitucional de paternidad y maternidad, pero que se ven recortadas por el artículo 88 del CNA, considerando que el derecho reflejado en normas no es siempre eficiente, por lo cual el derecho debe tomar en cuenta la importancia social tomando en consideración al derecho de todos los niños, niñas y adolescentes, regidos bajo el principio “El interés superior del Niño y adolescente”.

En el Capítulo I de esta presente tesis desarrollaremos la Introducción que contiene: la problemática del estudio de la presente investigación; así también la Justificación, Objetivos de investigación y Delimitación del estudio.

En el Capítulo II: Marco teórico, donde encontraremos los Antecedentes de la investigación, las Bases teóricas, el Marco conceptual, Hipótesis de trabajo y por ultimo las Categorías de estudio. En el Capítulo III: Método, abordaremos el Diseño metodológico y Diseño contextual.

En el Capítulo IV: Desarrollo temático, que está dividido en el Sub Capítulo I. Derecho de Alimentos. En el Sub Capítulo II: Derecho de Régimen de Visitas y en el Sub Capítulo III: El acceso a la justicia.

En el Capítulo V: desarrollaremos el Resultado y Análisis de los hallazgos, donde indicaremos el resultado del estudio, analizaremos los hallazgos, así como también la discusión y contrastación teórica de los hallazgos de la presente investigación el régimen de visitas y el derecho de alimentos como condición al acceso a la justicia en los Juzgados de Tambopata.

The present research work "THE VISITING REGIME AND THE RIGHT TO FOOD AS A CONDITION FOR ACCESS TO JUSTICE IN THE COURTS OF TAMBOPATA", arises the social legal problem, because it affects all the families of the country immersed in the processes of regime of visits, of those parents who claim the right for their children even the same minors who have the constitutional right of paternity and maternity, but who are cut by article 88 of the CNA, considering that the right reflected in regulations is not always efficient, for which the law must take into account the social importance taking into consideration the right of all children and adolescents, governed by the principle "The best interests of children and adolescents."

In Chapter I of this thesis we will develop the Introduction that contains: the problem of the study of the present investigation; as well as the Justification, Research Objectives and Study Delimitation. In Chapter II: Theoretical framework, where we will find the research background, the theoretical bases, the conceptual framework, working hypotheses and finally the study categories. In Chapter III: Method, we will address the Methodological Design and Contextual Design. In Chapter IV: Thematic development, which is divided into Sub Chapter I. Food Law. In Sub Chapter II: Visitation Rights and in Sub Chapter III: Access to justice. In Chapter V: we will develop the Result and Analysis of the findings, where we will indicate the result of the study, we will analyze the findings, as well as the discussion and theoretical contrast of the findings of the present investigation, the visitation regime and the right to food as condition for access to justice in the Courts of Tambopata.
