Confinamiento social por COVID - 19 y su implicancia en la violencia contra la mujer en el distrito de Santa Ana, La Convención, 2020

Abstract

La presente investigación tuvo por objetivo general, analizar la implicancia del confinamiento social por COVID - 19 en la violencia contra la mujer en el distrito de Santa Ana, La Convención, durante el año 2020, se postuló como hipótesis general que, la implicancia del confinamiento social por COVID - 19 en la violencia contra la mujer en el distrito de Santa Ana, La Convención, durante el año 2020, fue colocarlas en mayor situación de vulnerabilidad.La investigación fue cualitativa, de tipo dogmático jurídico, las hipótesis fueron validadas y la conclusión principal fue que la implicancia del confinamiento social por COVID - 19 en la violencia contra la mujer en el distrito de Santa Ana, La Convención, durante el año 2020, fue colocarlas en vulnerabilidad. Asimismo, de las muestras que conformo la investigación fue 10 expedientes, denuncias que ingresaron a inicio de pandemia, entre los meses de marzo, abril y mayo y para el recojo de datos se ha empleado una ficha de análisis documental. Se determinó los motivos de por los que el confinamiento social por COVID 19 produjo mayor vulnerabilidad de la mujer en el distrito de Santa Ana, La Convención, durante el año 2020, como son, el estrés personal, la dependencia económica frente a su agresor, el temor a denunciar por miedo a represalia, sumado a ello, la ineficacia del decreto legislativo 1470, el cual establece medidas para garantizar la atención y protección de las víctimas de violencia durante la emergencia sanitaria, y que dicha ejecución no resulto eficaz en el Distrito de Santa Ana. La recomendación fundamental está dirigida a la Municipalidad Provincial de La Convención, para que habilite con prontitud una casa hogar de refugio, para que se garantice y salvaguarde la integridad personal de la mujer víctima de violencia familiar. Del mismo se recomienda a la Policía Nacional de Perú, mayor atención prioritaria a mujeres con casos reiterados en violencia Familiar, así como la ejecución inmediata de las Medidas de Protección, de acuerdo al Decreto Legislativo 1470.

Likewise, of the samples that made up the investigation, there were 10 files, complaints that were entered at the beginning of the pandemic, between the months of March, April and May, and a documentary analysis sheet was used for data collection. The reasons why social confinement by COVID 19 produced greater vulnerability of women in the district of Santa Ana, La Convención, during the year 2020, such as personal stress, economic dependence on their aggressor, were determined. The fear of reporting for fear of retaliation, added to it the ineffectiveness of Legislative Decree 1470, which establishes measures to guarantee the care and protection of victims of violence during the health emergency, and that said execution was not ineffective in the District of Santa Ana. The fundamental recommendation is addressed to the Provincial Municipality of La Convención, so that it promptly set up a home of refuge, since through this, the personal integrity of the woman victim of family violence in her home can be guaranteed and safeguarded. In the same way, recommend to the National Police of Peru, greater priority attention to women with repeated cases of Family violence, as well as the immediate execution of Protection Measures, according to Legislative Decree 1470.
