Abstract: El mundo digital se ha expandido a lo largo de los años cambiando de perspectiva a la
sociedad, dando un salto sorprendente en información y conocimiento, reconociendo el valor
de esta información, sin embargo hubo muchos casos en los que se observó que el derecho a
la intimidad se vio afectado. Asimismo con la aparición de nuevas tecnologías de
información mucho más eficaces y rápidas, también se ha visto un aumento en la vulneración
de dicho derecho que pertenece a la materia del ámbito del derecho constitucional. Esta
revolución tecnológica ha cambiado no solo el dinamismo de la sociedad actual, sino también
el comportamiento de las personas, por lo cual hoy en día es la red la manera más rápido de
llegar a más personas. Por lo que es oportuno analizar los nuevos elementos para valorar las
relaciones personales entre sí y la convivencia con las nuevas herramientas de información,
las cuales nos referimos al uso de internet en el ámbito de las redes sociales, uso indebido de
archivos computarizados, asimismo tecnologías que permiten el comercio electrónico, el
registro electrónico y asimismo medios que permiten a través de cámaras registrar imágenes
estáticas o móviles incluso con sonido, cámaras infrarrojas, micrófonos, sistemas de
Posicionamiento Global (GPS), programas de control a distancia en computadores y otros
medios que permiten vigilar incluso clandestinamente a las personas y que algunos los han
utilizado para afectar la esfera íntima, personal y familiar de otros. Refiriéndonos también a
los datos personales constituidos por los datos biométricos que por sí mismos pueden
identificar al titular; datos referidos al origen racial y étnico; ingresos económicos, opiniones
o convicciones políticas, religiosas, filosóficas o morales, afiliación sindical, e información
relacionada a la salud o a la vida sexual, que impactan al derecho a la intimidad por las nuevas
circunstancias de ataque, por ejemplo observando, escuchando o registrando un hecho,
palabra, escrito o imagen para la divulgación de las vicisitudes personales y familiares.

Likewise, with the emergence of new, much more efficient and faster information technologies, there has also been an increase in the violation of said right that pertains to the subject of constitutional law. This technological revolution has changed not only the dynamism of today's society, but also the behavior of people, so today the network is the fastest way to reach more people. So it is appropriate to analyze the new elements to assess personal relationships with each other and the coexistence with new information tools, which we refer to the use of the Internet in the field of social networks, misuse of computerized files, as well as technologies that allow electronic commerce, electronic registration and also means that allow cameras to register static or mobile images even with sound, infrared cameras, microphones, Global Positioning Systems (GPS), remote control programs in computers and other media that allow people to even monitor people clandestinely and that some have used them to affect the intimate, personal and family sphere of others. Referring also to the personal data constituted by the biometric data that by themselves can identify the holder; data referring to racial and ethnic origin; economic income, opinions or political, religious, philosophical or moral convictions, union affiliation, and information related to health or sexual life, which impact the right to privacy due to the new circumstances of attack, for example by observing, listening or recording a fact, word, writing or image for the dissemination of personal and family vicissitudes.
