The present research work aims to carry out an analysis regarding the application of shared tenure in relation to the principle of special protection of children in the Family Courts of Cusco specifically in the years 2018 – 2019, that is, whether or not this is being applied in all its dimension in those cases of shared tenure, all in this in attention because currently too many divorces and separations of fact originate, being an alternative the shared tenure however this legal figure is referred to time, that is to say share from the aspect of the rights of the parents, but not from the perspective of the child, which will have as a consequence that instability is generated and other factors where it will be violated. This direction is taken since it is an issue of great relevance in our society, this approach is made specifically on the application of the principle of special protection of the child in those cases in which shared custody is granted either in different periods or why it is not granted, this because the child following the de facto separation or divorce of his parents, they undergo major changes that affect their normal development. To this end, an integral analysis of files was carried out in those cases of shared tenure included in the years 2018-2019, as well as interviews were conducted through a questionnaire to Magistrates of the Family Courts of the Judicial District of Cusco because they are experts in the subject.
