In the present investigation are analyzed issues related to Extrajudicial Conciliation, established in our legal system by Law 26872 - Law of Conciliation Extrajudicial, establishing in Article 6 to the conciliatory attempt as a mandatory requirement at the time of filing a lawsuit, without However, the requirement of this requirement leads to the loss of the true spirit of conciliation, which is to promote a culture of peace, as referred to in Article 2 of the Extrajudicial Conciliation Law. In the present work it has as its main problem: What is the juridical dogmatic support that justifies a legislative proposal, to modify the art. 6th and 9th of the Extrajudicial Conciliation Law? In the development of the investigation were analyzed the concepts of conciliation, effective jurisdictional protection, the principle of procedural economy, the autonomy of the will and the right of access to the Justice. In the present investigation it is possible to base the modification of the Law of conciliation, with respect to articles 6 and 9 provided for by said law, which establishes as mandatory having recourse to conciliation before filing a lawsuit in the judicial . The legislative proposal made is based on the analysis of the doctrine and national legislation.
