The present work, titled "Social and Legal Factors Necessitating the Regulation of Legaltech Usage to Protect the Principles Stated in Article III of the Preliminary Title of Law No. 29497, Regulating the Peruvian Labor Process," addresses the general issue of social and legal factors requiring the regulation of Legaltech. This directly impacts the tutelary principle within the labor process, focusing on the Peruvian labor process and emphasizing its protective nature and the need for equity between the parties. The research demonstrates the lack of regulation of technological tools, emphasizing that legal and social factors in this context can lead to excesses or distortion of the process. It proposes a regulatory framework to prevent the legislation from being surpassed in the future. Additionally, the absence of notification and regulation of Legaltech in the legal system is mentioned. The identified deficiencies in Law 29497 regarding the use of these tools are detailed, suggesting that these shortcomings could contravene the principles of labor procedural norms and affect the rights of the involved parties. Therefore, interviews with operators were conducted to determine possible violations of due process, resulting in a disadvantage due to the use of Legaltech. An analysis of all the surveys was subsequently conducted, and the results were used to draw conclusions, which, in turn, were employed to make recommendations for this research.
