This thesis deals with the development of doctrine, legislative and jurisprudential level, around the consequences and legal relevance of the third party property, specifically refers to the existence of a conflict of rights of a different nature from an embargo registered (credit) and the property is not registered, the problem raised in the seventh Plenum Civil Casatorio constitutes a legal precedent in which binding rules that relate directly to the courts of the country are issued; in this context we have as a reference point the second paragraph of the Civil Code, in which the problem stated above and whose varied interpretation generated antagonistic to the level of the Supreme Court pronouncements article presents 2022; what was intended with the Seventh Plenum Civil Casatorio was to unify criteria on the correct interpretation of Article pre quoted ending the legal uncertainty in addition to providing predictability in subsequent resolutions; Thus the aim of this thesis is to analyze the various discordant executory that led to the issuance of a plenary casatorio also make an analysis of the fundamentals of the court with the presentation of amicus curiae finally establishing whether binding rules issued in the seventh Plenum Civil Casatorio fit our current sociocultural context respecting international rules; We found so that the Inter-American Court of Human Rights in the Case of Tibi vs. Ecuador in reference to the conflict of rights between a tercerista whose right to property is not registered and enrolled embargo represents the right credit solved this conflict of rights different nature establishing the foundation 219 that “this record is necessary for the sole purpose of the enforceability on the claim of a third party is to have any right over the good.“ Aspects that develop throughout our thesis in order to establish our position.
