Resumen: La presente investigación aborda cómo es posible superar la vulneración
al principio de seguridad jurídica debido a la ausencia normativa del precedente
electoral vinculante en la legislación electoral peruana y cuáles serían las
razones que justificarían la obligatoriedad de las resoluciones del Pleno del
Jurado Nacional de Elecciones en materia electoral.
En ese ánimo, la metodología utilizada fue de tipo dogmático propositiva.
Dogmático porque en ella se abocará al estudio de fuentes formales del Derecho,
como: la Constitución Política del Perú, Ley Orgánica del Jurado Nacional de
Elecciones, jurisprudencia del Tribunal Constitucional y doctrina nacional e
internacional sobre la materia; y, es propositiva, ya que mediante este estudio se
pretende establecer las razones (en abstracto) que justifican la modificación de
una disposición normativa para la implementación de una institución jurídica: el
precedente electoral vinculante. Asimismo, el enfoque de la investigación es
cualitativo porque el objetivo de ésta es analizar un fenómeno: la inclusión del
precedente electoral vinculante en el proceso de electoral peruano, por lo que no
contiene mediciones estadísticas o ensayos empíricos.
Los resultados más resaltantes de la investigación demuestran que el
Derecho peruano presenta elementos estructurales en favor del uso de
precedentes y que éstos son una herramienta para la realización del principio de
seguridad jurídica en los procesos electorales en el Perú.
The present research addresses how to overcome the violation of the principle of legal certainty due to the absence of a binding electoral precedent in Peruvian electoral legislation, and what would be the reasons to justify the mandatory nature of the resolutions of the National Elections Jury Plenum in electoral matters. In this regard, the methodology used was a dogmaticpropositional approach. Dogmatic because it will focus on the study of formal sources of law, such as the Peruvian Political Constitution, the Organic Law of the National Elections Jury, the jurisprudence of the Constitutional Court, and national and international doctrine on the subject; and propositional because through this study, the reasons (in abstract) that justify the modification of a normative provision for the implementation of a legal institution: the binding electoral precedent, are intended to be established. Also, the research approach is qualitative because its objective is to analyze a phenomenon: the inclusion of the binding electoral precedent in the Peruvian electoral process, so it does not contain statistical measurements or empirical essays. The most outstanding results of the research demonstrate that Peruvian law presents structural elements in favor of the use of precedents, and that these are a tool for the realization of the principle of legal certainty in electoral processes in Peru.
