Factores que influyen en el incumplimiento de las sentencias de alimentos del primer juzgado de paz letrado de Sicuani del año 2018

Abstract

El presente trabajo de investigación titulado “Factores que influyen en el incumplimiento de las sentencias de alimentos del Primer Juzgado de Paz Letrado de Sicuani del año 2018”, tuvo como problema general ¿Cuáles son los factores que influyen en el incumplimiento de la sentencia de alimentos del Primer Juzgado de Paz Letrado de Sicuani de la Provincia de Canchis, Región de Cusco del año 2018?, y como objetivo principal es conocer los factores que influyen en el incumplimiento de la sentencia de alimentos del Primer Juzgado de Paz Letrado de Sicuani de la Provincia de Canchis, Región de Cusco del año 2018. El trabajo de investigación tiene como hipótesis general, los factores que influyen en el incumplimiento de la sentencia de alimentos del Primer Juzgado de Paz Letrado de Sicuani de la Provincia de Canchis, Región de Cusco del año 2018, son económicas, sociales, morales y psicológicas, pero para probar nuestras hipótesis observaremos y analizaremos también sobre los sujetos de derecho por cuanto lo reconoce la Constitución en el artículo N° 02 y el Código Civil Peruano en su artículo N° 1, donde se reconoce al concebido como sujeto de derecho para todo cuanto le favorece (alimentos). El tipo de la investigación fue básica, diseño no experimental, enfoque mixto, en esta investigación se prescindió de la población y muestra de estudio la encuesta a los alimentistas, obligados y abogados además al Juez del Primer Juzgado de Paz Letrado de la Ciudad de Sicuani, de la provincia de Canchis, departamento de Cusco, se hizo uso de la técnica de la encuesta y observación, además que los instrumentos de cuestionario y ficha de observación con el cual se llegó a los resultados que ahora contamos.

The present research work entitled “Factors that influence non-compliance with the maintenance sentences of the First Law Court of Sicuani of the year 2018”, had as a general problem: What are the factors that influence the non-compliance with the maintenance sentence? of the First Legal Peace Court of Sicuani of the Province of Canchis, Cusco Region of the year 2018?, and the main objective is to know the factors that influence the non-compliance with the food sentence of the First Legal Peace Court of Sicuani of the Province of Canchis, Region of Cusco of the year 2018. The research work has as a general hypothesis, the factors that influence the non-compliance with themaintenance sentence of the First Legal Peace Court of Sicuani of the Province of Canchis, Region of Cusco del year 2018, they are economic, social, moral and psychological, but to test our hypotheses we will also observe and analyze the subjects of law as recognized by the Constitutionin article No. 02 and the Peruvian Civil Code in its article No. 1, where the child is recognized as a subject of law for everything that benefits him (food). The type of research was basic, non-experimental design, mixed approach, in this research the population and study sample were dispensed with, the survey of alimony holders, obligors and lawyers as well as the Judge of the First Law Court of the Peace of the City of Sicuani , from the province of Canchis, department of Cusco, the survey and observation technique was used, in addition to the questionnaire instruments and observation sheet with which the results that we now have were reached.
