Resumen: La presente investigación versa sobre la actual aplicación que se está dando del proceso inmediato, el cual se modificó mediante el Decreto Legislativo N° 1194, haciéndolo obligatorio para los casos de flagrancia, omisión de asistencia familiar y conducción de vehículo en estado de ebriedad, y tomándolo en ese entender para su aplicación por parte del Ministerio Público.
En esta investigación se abarcara, lo referente a la vulneración del derecho de defensa mediante la aplicación expeditiva del proceso inmediato, ya que por los cortos plazos contemplados en el proceso inmediato el abogado del imputado no puede preparar una adecuada estrategia de defensa y así aportar medios probatorios, en los delitos que no son considerados de bagatela, de igual forma transgrediendo lo que es el debido proceso.
La metodología usada para desarrollar la investigación es el enfoque cualitativo, así como el alcance de investigación jurídica es dogmático – descriptivo, debido a que en la presente investigación se busca describir ―los rasgos de los fenómenos facticos‖ (Aranzamendi, 2015) de la afectación del derecho de defensa del imputado con la aplicación expeditiva del proceso inmediato.
Desarrollándose dentro de las bases teóricas primeramente lo que es las garantías de la administración de justicia lo que es referente a la tutela jurisdiccional efectiva, el derecho de defensa así como el derecho de defensa técnica y la presunción de inocencia. Seguido el proceso penal, siendo este un análisis partiendo del Código de Procedimientos Penales y observando los tipos de procesos que con este se daban como son el ordinario y el sumario, también el proceso penal actual, tomándose en este punto el proceso común y luego lo referente al proceso inmediato.
Analizándose las respuestas obtenidas mediante los cuestionarios realizados a los jueces, fiscales y abogados litigantes de la ciudad del Cusco, así como las sentencias referentes al proceso inmediato tramitadas en los Juzgados Penales de la sede central de la Corte Superior de Justicia del Cusco durante el año 2016, estos datos son sólo de carácter referencial en la presente investigación. Llegando a determinarse como conclusión principal, que la aplicación expeditiva del proceso inmediato vulnera el derecho de defensa, al no poder el abogado del imputado aportar medios probatorios por la brevedad de los plazos en que se desarrolla el proceso inmediato, generando una afectación al debido proceso, esto se da referente a los delitos que no son considerados de bagatela. Ocasionándole inconvenientes no sólo al abogado del imputado sino también al representante del Ministerio Público y a los jueces penales.

The methodology used to develop the research is the qualitative approach, as well as the scope of legal research is dogmatic - descriptive, because in the present research it is sought to describe “the traits of factic phenomena“ (Aranzamendi, 2015) Of the right of defense of the accused with the expeditious application of the immediate process. Developing within the theoretical bases first what is the guarantees of the administration of justice what is related to effective judicial protection, the right of defense as well as the right of technical defense and presumption of innocence. Following the criminal process, this being an analysis starting from the code of criminal procedures and observing the types of processes that were given with this as are the ordinary and the summary, also the current criminal process, taking in this point the common process and then Concerning the immediate process. Analyzing the answers obtained through the questionnaires made to the judges, prosecutors and trial lawyers of the city of Cusco, as well as the sentences referring to the immediate process processed in the Criminal Courts of the headquarters of the Superior Court of Justice of Cusco during the year 2016, these data are only of a referential nature in the present investigation.
