Resumen: La celebración de contrato de compra-venta a favor del hijo menor de edad es muy común en nuestra sociedad, pero los efectos de dicho contrato generan conflictos a futuro; como es el caso de los padres que compran una propiedad a nombre del primer hijo menor de edad que concibieron, quien mediante la celebración de este tipo de contrato, pasa a ser propietario absoluto del bien inmueble; y en el caso que los padres concibieran otros herederos más, estos ya no tendrían derecho a herencia porque su hermano sería propietario del bien inmueble, o cuando los padres no tienen bienes propios, mas solo, los que adquirieron en sociedad de gananciales, que en este caso, lo adquieren a nombre de sus menores hijos, y estos incurren en causas de indignidad o desheredación, estos ya no podrán resolver el contrato; es por todos estos argumentos y un requisito que se cuestiona la celebración de contrato de compra-venta a favor del hijo menor de edad, como es el de la oferta por que en dicha celebración, el menor de edad no podrá demostrar el origen del dinero que ahora es exigida por Ley Notarial por el lavado de Activos y por la Ley Tributaria por la Evasión (Ley N°28194), a menos que tenga bienes propios, dejados por herencia o legado. Por todo ello, estos contratos deberían ser celebrados como un Anticipo de Legítima por la condición de heredero o herederos forzosos para estar sujeto a Colación, además que se rige por las normas del Contrato de Donación y por ende se podría invocar su Revocación en los casos de indignidad para suceder y el de desheredación.
