This thesis pursued to unravel the historical, social, and legal causes of the close relationship between the Catholic Church and the Peruvian State, as well as determining and understanding the factors that caused that relationship to occur in a different way and contrary to what happened in other latitudes of the world, where such a link evolved until the establishment of the ideal secular more than two hundred years ago, consolidated today, unlike what happens and is perceived in Peru, despite the fact that it was born as a republic when modern secular states had already been established as a result of the liberal revolutions of the modern age. As a general framework, it was sought to analyze the origin, development and evolution of the political, social and legal link between the Catholic Church and the State throughout universal history, in order to achieve secularism, and then examine them. topics at the level of the colonial and republican history of Peru as a specific context, in addition to studying the regulation of such links in the repealed constitutions and in the current constitutional framework, as well as highlighting the benefits of a secular State and proposing concrete measures that allow the country to advance towards the secular ideal; Being social and legal phenomena, the research approach used was the qualitative one because it best adjusted to social science research, the type of study is dogmatic-historical, since the legal institution of the secular State is studied from a historical perspective. The most remarkable finding of this research is that the strong Catholic tradition of the Peruvian nation, originated in the colonial era, has marked the history of the relationship between the State and the Catholic Church up to the present, influencing the Church on the State, its legislation and decisions, which served as the only cohesive element for the founding of the republic, therefore, the State took it as the basis of organization, which determined a confessional State in most of the republican era powerfully influenced by such creed until today , and a close collaborative relationship, a dynamic radically different from that followed by the secular states that emerged at the end of the 18th century, whose model was followed by the vast majority of countries.
