This study presents a critical analysis of the need to modify Law No. 30947, known as the Mental Health Law in Peru, following the examination carried out by the Constitutional Court in file 00009-2020-PI/TC. Although the claim of unconstitutionality was declared unfounded by the Court, the analysis of the file highlights the importance of a constant review of the law to guarantee its consonance with the principles and rights established in the Peruvian Constitution, especially with regard to the protection of human rights and social justice. The study proposes specific amendments to the law, focused on strengthening human rights provisions, improving the effective decentralization of mental health services, and increasing transparency and accountability. These modifications not only aim to improve the alignment of the law with constitutional principles, but also its practical effectiveness, ensuring accessible, equitable and high-quality mental health care for all Peruvians. Likewise, a continuous and sustained commitment by health authorities is recommended for the effective implementation of these modifications, including the adequate allocation of resources and the active participation of communities and mental health professionals. It also highlights the need for a periodic review and update of the law to address emerging challenges in the dynamic field of mental health, thus ensuring that the mental health system in Peru evolves and responds effectively to the needs of its population. In conclusion, this study maintains that the proposed modifications to the Mental Health Law are necessary and beneficial, reflecting Peru's commitment to the protection of human rights and the continuous improvement of its mental health system.
