The objective of this study was to evaluate compliance with rural land titling and forestry legislation in rural land titling procedures in the departments of Loreto and Ucayali. The methodology required the analysis of forestry and rural land titling legislation, relevant policies and plans and technical documents. Information was then requested from state entities concerning the classification of land by its capability – CTCUM (by its acronym in Spanish) of titled rural lands, the number and area of titled rural lands, and geographic information of the territorial units - UT where a state project plans to title rural lands. The information was systematized through databases and land cover classification maps of the UT and then analyzed. The results indicate that during the period 2016 - July 2022, the Regional Directorate of Agriculture of Ucayali titled 2,262 rural plots with a total area of 28,062 hectares, which did not have the approved CTCUM, a requirement of the forestry and rural land titling legislation. Likewise, if the titling of the UT of Loreto and Ucayali is executed, 41,009.29 ha of natural forests would be titled. The analysis of sectoral policies verified that these are not the origin of the problem of the weakness in the implementation of the CTCUM in the rural land titling process. The main recommendations are: 1) During the determination of the UT, exclude lands whose land capability is forest production or protection and areas covered by primary forests. 2) Provide the National Forestry and Wildlife Service with a binding opinion in rural land titling procedures, 3) Incorporate the maintenance of forests as a form of economic exploitation in the rural land titling procedure.
