There are uncountable transformations that the context of a family has suffered throughout the time, that is why we put our selves into analyzing the rights of those who conform the denominated Assembled Family, which is the case of Social Parents because when they get involved in this dynamic, they assume duty and obligations which traditionally and jurisdictionally only can be done by biological parents, so we believe that is enough motivation to think in the possibility of legal recognizement in Food Rights for social parents, even though, their current needs is a consequence that the social parent has assumed duties in the past respect to his or her social children which is common in these kinds of families. The investigation has as purpose to establish legal foundations so that help determines the recognizement in food rights for Social Parents of Assembled Family in Peru. In this case, we have used the method of basic investigation in exploratory level, legally dogmatic and socially functional, in that sense, we got as a result, what we know as the jurisdictional basis to recognize food rights for social parents of Assembled Families, to the principal of familiar solidarity, family state, and parental bond, so the social parent could claim food to his social children, in case of being in a state of necessity that puts in danger her or his own subsistence.
