For many years, there has been an obvious conflict in the rental market since, upon expiration of the contract or due to termination, the lessor of the property intends to recover it as soon as possible. On the other hand, the tenant aspires to stay in the property for as long as possible. Faced with this, one goes to the judiciary, but here the eviction processes last years and an efficient result is not obtained. For that, on April 24, 2019, Law N° 30933 was published, which regulates the special eviction procedure with the intervention of the notary, with subsequent modification through Emergency Decree N° 013-2020, with the purpose of restoring the property to the lessor or owner in the most agile and fast way possible. The law that remains in force but to date has received criticism from a large part of Peruvian doctrine since it is considered that said law would be unconstitutional and would not be applied efficiently as it does not completely solve the problem. Instead, another sector agrees with the enactment of the law and believes that, in effect, it will solve the problem. Therefore, considering this debate, the present investigation, which has as its research topic the special eviction procedure with notarial intervention regulated by Law N° 30933, aims to elucidate whether the law is indeed unconstitutional and, if so, analyze its causes and find possible solutions to this problem. At the same time, study its application in Lima in 2023.
