“The control of conventionality and its incidence on the rights of identity and equality in the Peruvian State were investigated, based on the change of the genetic biotype of the sex in accordance with the Civil Registry Law No. 2 6 4 9 7, which negatively affects such rights. Regarding the collection of data, documentary collection techniques were manipulated for the review of the research variables, with its registration sheet instrument (case analysis file); likewise, the review of international judgments on Human Rights, through its record sheet (case analysis sheet-comparative law); also the interviews conducted with judges of the Court of Trujillo, constitutional lawyers, with their interview booklet (interview form); Finally, the signing was used, through bibliographic and summary records for the compilation of theoretical data. The results were evidenced in tables, to elaborate the data discussion, the analysis methods were used - synthesis, deductive and hermeneutic, later the conclusions were inferred, which evidenced the positive incidence of the control of conventionality, in the guaranteed humanitarian rights in the Convention, by influencing the decision of the Judges, and State agents, to guarantee the rights endorsed in treaties or conventions, when the internal norm of the State that they are part of, violates them”.
